California Gov. Gavin Newsom has signed legislation that restricts the use of the state’s mental health diversion program in certain sex-crime cases, making it harder for accused child molesters to avoid conviction, according to the New York Post.

Supporters have dubbed the measure the “Epstein loophole” bill, arguing that California law has allowed some defendants accused of sexually abusing children to avoid prison by qualifying for mental health diversion before their cases ever reached trial. The new law narrows that option for defendants charged with specified child sex crimes.

The program, which has been in effect since 2018, forced judges to use the diversion program regardless of whether they thought the defendant was a continued threat to society.

The legislation was championed by victims’ advocates, who argued that the existing law was never intended to shield child predators from prosecution. They said the loophole had resulted in delayed justice for victims and, in some cases, prevented juries from hearing evidence altogether.

The bill received bipartisan support, increasingly rare in California’s polarized climate. Even critics of Newsom’s broader criminal justice policies welcomed the legislation as a step toward making certain that defendants accused of abusing children cannot avoid prosecution through a legal technicality.

The Post reported that the legislation follows growing criticism of California’s diversion law after several cases in which defendants charged with child sexual abuse sought to use mental health diversion to postpone or avoid criminal proceedings.

Newsom, a Democrat, has long been soft on crime, though he has moved to the right in several areas in recent years, possibly as a result of his expected run for president in 2028.

His move is in stark contrast to Democrat Minnesota Gov. Tim Walz’s doubling down on his leftist bona fides last week when he joined other members of the state’s pardons and parole board to issue a pardon to an immigrant to avoid having him deported for repeatedly raping a 10-year-old girl.

Whether Newsom is acting only for political points or has had a true wake-up moment — and the former is most likely — he is moving in the right direction. Walz is an ideologue willing to sacrifice the innocence of young children to score his own points with the far left.
