I keep coming back to two paragraphs from Richard Novak, the defense attorney for Tyler Robinson, during the preliminary hearing in the Charlie Kirk murder case.\u00a0\u00a0Read them carefully:<\/p>

It is true that Mr. Kirk spoke hatefully of certain groups of people. He spoke hatefully of people who don\u2019t have traditional norm-conforming gender identities. He spoke hatefully of people who are not strictly heterosexual. He spoke hatefully of people who have sexual relationships out of marriage.<\/p>\n

And yes, it is true that the evidence from Mr. Twiggs is that he identified in a non-gender-conforming way to his friends and that he was in a romantic relationship with Mr. Robinson. But that doesn\u2019t mean that those personal choices by Mr. Twiggs and by Mr. Robinson equate with the hate that at least Mr. Robinson says he had toward Mr. Kirk.<\/p>\n<\/blockquote>\n

There is a defense argument here.\u00a0\u00a0Novak was challenging the prosecution\u2019s theory of motive and arguing that the evidence did not establish that Robinson killed Kirk because of his political or religious views.\u00a0\u00a0Fine.\u00a0\u00a0That is what defense attorneys do.<\/p>\n

But then there is that phrase:\u00a0\u201cIt is true.\u201d\u00a0Not\u00a0Robinson believed<\/em>.\u00a0\u00a0Not\u00a0the prosecution alleges<\/em>.\u00a0\u00a0Not\u00a0some people regarded Kirk\u2019s words as hateful<\/em>.\u00a0\u00a0It is true.\u00a0\u00a0That is a very different proposition.<\/p>\n

Charlie Kirk is dead.\u00a0\u00a0He cannot answer for himself.\u00a0\u00a0Yet his beliefs, his words, and his character are being placed before the court as though they belong in the explanation for his own murder.<\/p>\n

The dead man has entered the courtroom.<\/p>\n

And look at what Novak chose to put on trial: Kirk\u2019s views on gender, sexuality, and sex outside marriage.\u00a0\u00a0Those are not political positions Charlie Kirk invented.\u00a0\u00a0They are rooted in the Christian faith he openly professed.<\/p>

Charlie Kirk did not write the Bible.\u00a0\u00a0He did not invent Christianity.\u00a0\u00a0He did not create Christian teaching on marriage or sexuality.\u00a0\u00a0He believed it, defended it, and spoke about it.<\/p>\n

So when those beliefs are characterized as\u00a0hate<\/em>, what exactly are we being asked to condemn?\u00a0\u00a0Charlie Kirk?\u00a0\u00a0Or Christianity?<\/p>\n

That is where this gets uncomfortable.\u00a0\u00a0Because if a Christian expresses a biblical belief about marriage, sexuality, or human identity, and that belief is introduced into a courtroom as evidence of \u201chate,\u201d the argument has moved beyond the defendant\u2019s alleged motive.\u00a0\u00a0It has moved into the territory of faith itself.<\/p>\n

When did quoting the Bible become hate speech?<\/p>\n

The Christian principles Charlie Kirk defended predate him by roughly two thousand years.\u00a0\u00a0That is why Novak\u2019s wording deserves scrutiny.<\/p>\n

A man accused of killing Charlie Kirk is entitled to a vigorous defense.\u00a0\u00a0His attorney is entitled to challenge the prosecution\u2019s evidence and its theory of motive.\u00a0\u00a0But Charlie Kirk is entitled to something, too.\u00a0\u00a0He is entitled not to be put on trial simply because he is no longer alive to defend himself.<\/p>\n

The first killing took Charlie Kirk\u2019s life.\u00a0\u00a0The second begins when his beliefs are placed in the dock.<\/p>
