There was an \u201casylum of cuckoos\u201d in the Lindsay Clancy trial.\u00a0\u00a0Clancy herself doesn\u2019t even deserve that ascription \u2014 she is pure evil.\u00a0\u00a0Occasionally, the courtroom cameras would capture her contorted face and scary eyes that reflected her dark soul.\u00a0<\/p>

There were lots of cuckoos-in-the-head wearing pink.\u00a0\u00a0Who let them out of the asylum?\u00a0\u00a0They don\u2019t benefit society,\u00a0\u00a0but they sure can scream when they know there is police protection.\u00a0\u00a0One wonders who is paying them.<\/p>\n

Another cuckoo-in-the-head was Clancy\u2019s chief legal counsel, Kevin Reddington.\u00a0\u00a0Per those who devote themselves to such legal observations, he did a commendable job throughout the beginning of the trial but was too performative during closing arguments.\u00a0\u00a0Then he demanded that the judge to be more animated when instructing the jury, rather than \u201cgloss over\u201d things.\u00a0\u00a0The level-headed judge retorted that he read the instructions clearly, and he\u2019s not an actor infused with pizzazz.<\/p>\n

Reddington\u2019s repetitive calls for the judge to dismiss the holdout juror also resemble the monotonous behavior of cuckoos (though they have ulterior mating motives).<\/p>\n

To be gracious, let\u2019s give Reddington credit for his robust defense, even if it was sometimes cuckoo.\u00a0\u00a0More troubling was his unseemly news conference after the mistrial announcement.\u00a0\u00a0After saying this is not a time for gloating, that\u2019s exactly what he did.\u00a0\u00a0Often there is a degree of collegiality between opposing lawyers, if not grudging professional respect, but Reddington\u2019s taunts of the Plymouth County district attorney were gratuitous.<\/p>\n

Even more churlish, instead of expressing gratitude and support for our jury system, he leveled personal attacks at the holdout juror.\u00a0\u00a0It\u2019s one thing to defend his client dutifully, but entirely another to deride a conscientious juror in this age of doxing.\u00a0\u00a0What a nasty piece of work Reddington is.\u00a0\u00a0If he were a bird, it\u2019d be cuckoo; after all, they also practice ruthless strategies.<\/p>

I\u2019m sure the pink-wearing feminists will praise the female\u00a0foreman<\/em>, but she also exhibited cuckoo behavior.\u00a0\u00a0Indeed, the judge virtually chastised the jury (with a light touch, because he is a decent chap) not to represent the deadlock with precise numbers.\u00a0\u00a0In other words, don\u2019t pass notes that indicate the breakdown is 11-1.<\/p>\n

The female foreman\u2019s note to the judge about permanent deadlock is also cuckoo \u2014 to wit, \u201cit is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to.\u201d<\/p>\n

\u201cHeavy heart\u201d?\u00a0\u00a0How dare she invoke such emotion?\u00a0\u00a0What a bunch of feminine fluff.<\/p>\n

Assuming she wasn\u2019t a messy bundle of emotions behind closed doors, she should be proud of the jury\u2019s long deliberations.\u00a0\u00a0Indeed, after declaring the mistrial, the judge commended their service with deep sincerity, not a heavy heart.\u00a0\u00a0The judge manages the law, and the jury is supposed to focus on the facts \u2014 facts, just the facts, ma\u2019am.\u00a0\u00a0There is reason to have a \u201cheavy heart\u201d regarding the atrocities Clancy committed on three of God\u2019s wonderful children, but not regarding the jury\u2019s efforts.<\/p>\n

So who flew out of this cuckoo\u2019s nest?\u00a0\u00a0The lone holdout juror, that\u2019s who.\u00a0\u00a0Presuming he not only understood the judge\u2019s instructions about reasonable doubt, but conscientiously applied them in deliberations, then he is a hero.\u00a0\u00a0That\u2019s a strong word, but how else to describe someone who stood his ground during interminable discussions, and didn\u2019t falter even after a Tuey-Rodriguez instruction?\u00a0\u00a0The\u00a0one<\/em>\u00a0remained resolute against the tyranny of the majority.\u00a0\u00a0That\u2019s the system, despite the cuckoos.<\/p>
