There is\u00a0substantial evidence\u00a0that someone may be prone to alcohol use disorder (AUD) if his family has a history of misuse.\u00a0\u00a0It\u2019s easy to condemn such moral turpitude, but we all know some otherwise upstanding people who have succumbed to debilitating AUD, with horrendous consequences.\u00a0\u00a0Unfortunately, they \u201cchose\u201d the wrong parents.\u00a0<\/p>\n

Alcohol is the devil\u2019s drink.\u00a0\u00a0It can truly play havoc with both mental functioning and exercise physiology.\u00a0\u00a0The human brain seeks equilibrium, so the initial jollies that alcohol elicits invariably lead to chemical reversals (partially manifested as a \u201changover\u201d) to compensate for the initial high.\u00a0\u00a0Repeated impairment can lead to\u00a0long-term depression.\u00a0\u00a0In some severe cases, it is not a stretch to describe the behavior of someone under its chronic influence as \u201cinsane.\u201d<\/p>\n

The other day, I watched a couple episodes of the real-life show\u00a0Cops<\/em>.\u00a0\u00a0For the most part, the cops are truly admirable in their interactions with the public.\u00a0\u00a0Nevertheless, I was taken aback by how harshly the law treats down-on-their-luck alcoholics.\u00a0\u00a0Whatever their offense, they are carted off in cuffs.\u00a0\u00a0Often, that\u2019s entirely proper \u2014 for their own safety and that of the public at large.\u00a0\u00a0Most crimes only require\u00a0general intent<\/em>\u00a0(choosing to perpetrate an illegal act, without full regard for or appreciation of the specific consequences), and being drunk does not usurp that.<\/p>\n

For\u00a0specific intent<\/em>\u00a0crimes (like first-degree murder), there is the option of a diminished capacity defense \u2014 for example, the criminal was too inebriated to form a specific plan.\u00a0\u00a0This is known as\u00a0mens rea<\/em>,\u00a0which can be summarized\u00a0as\u00a0<\/em>\u201dthe act is not culpable unless the mind is guilty.\u201d\u00a0\u00a0It doesn\u2019t clear the person of all guilt, but it\u00a0may reduce the charge.<\/p>

Diminished capacity defenses based on alcoholism or voluntary intoxication have an\u00a0exceptionally low success rate.<\/p>\n

A compassionate conservative may wonder: Given the high rate of hereditary alcoholism, how much intoxication is truly \u201cvoluntary\u201d?\u00a0\u00a0Sure, we have free will when it comes to our conscious thoughts, but demons underneath are tempting those who are predisposed (hereditarily or genetically) to the devil\u2019s drink.\u00a0\u00a0Up to\u00a060 percent of patients relapse\u00a0with the first year of treatment for AUD.\u00a0\u00a0We should be circumspect in condemning them all as lacking morality or agency.\u00a0<\/p>\n

The following seems reasonable, presuming reason prevails in leftist Massachusetts.\u00a0\u00a0Someone who imagines hearing a single, sudden male command to perpetrate an atrocity, then methodically and deceptively plans a triple-filicide, then brutishly executes it within a narrow time frame, then asks about lawyers, has formed about as much specific intent as someone suffering from AUD could possibly muster.<\/p>\n

Why legally treat one differently from the other?\u00a0\u00a0Best to send them both off to jail for a long time.<\/p>
