Few are surprised, but many are furious.<\/p><p>Read more <a href=\"https:\/\/interstatelogisticshubs.com\/?p=3301\">The Yellowstone attack: The facts<\/a><\/p>\n<p>Justice Thomas said that history disagrees that the 14th Amendment grants birthright citizenship. \u201cDomicile\u201d status, he argued in his dissent, tells where someone is \u201csubject to the jurisdiction thereof.\u201d Chief Justice Roberts, however, likes to avoid drastic changes. Barrett may let her nurturing instincts influence her decisions. Kavanaugh seemed more like a double agent leaking a rescue maneuver. With a 6-3 ruling (arguably 5.5-3.5) the black-robed nine officially made the border a game of red rover.<\/p>\n<p>When I was in elementary school, red rover was a favorite recess pastime for my insecure male ego. The rowdy playground game splits players into two teams. They form horizontal lines about 30 feet apart and face each other. Players in each team link hands to form a wall. One team picks a member of the other to run at them and try to smash through their grip.<\/p>\n<p>\u201cRed rover, red rover, let Daniel come over!\u201d they yell. I charge like an angry bull from my team, looking for a weak link in theirs. If I split two hands, I could pick a victim to join my team. If I fail, I must join the other team. The teams alternate until one team fully assimilates the other.<\/p>\n<p>What does red rover have to do with a Supreme Court ruling? A secure border where the rule book itself promises a prize for breaking it. In <em>Mullin v. Al Otro Lado,<\/em> the Court determined asylum claims must begin inside the United States. In <em>Mullin v. Doe<\/em> they ruled that the President could end Temporary Protected Status for some Haitians and Syrians. Temporary, it turns out, actually means temporary. The original protection for both groups was 18 months. After a decade and a half, the high court ruled these refugees can return to their homelands. Their original emergencies are long over. Debates aside, laws can mean what they say.<\/p>\n<p>These two decisions gave a hat tip to stronger border and immigration control. That brings us back to birthright citizenship. Three of the justices who nodded for stronger borders shook their heads at protecting citizenship from foreign exploitation. The Constitution, we must infer, allows even foreign terrorists to give birth to new American citizens. The border is now officially a game!<\/p>\n<p>How do we square <em>Trump v. Barbara<\/em> with <em>Mullin v. Doe<\/em>? The Haitians and Syrians who came temporarily aren\u2019t citizens, but many have had children. Those children are now citizens. Because the children aren\u2019t naturalized, the government can\u2019t denaturalize and deport them. Their parents, who must leave. now have a choice. They can go without their children, which would be inhumane. We can try to hold the line at the border. If we catch invaders, we may send them back. But if they penetrate and give birth, they\u2019ve won the game. A child could be born in the United States, grow up in another country, and use this dual citizenship to try to influence their birthplace. Too many of these with foreign interests could strain cultural unity.<\/p>\n<p>Because of a language loophole in the 14th Amendment, national security is like a game of red rover. But, unlike the real game, this version is rigged against our side. Our team has less reason to send runners. We don\u2019t get to pick who should \u201ccome over.\u201d If our team holds the line, we often have to wait out a long process to get that runner to leave.<\/p>\n<p>If a runner breaks through our line, he doesn\u2019t have to add anyone to his team. He can still join ours while playing for the other. When the next comes charging, our new team member may release his grip and welcome his colleague.<\/p>\n<p>As the game progresses, our team grows, but the other is secretly gaining control. Because this country is forced to play a game, our immigration policy is only skin deep. We\u2019re allowed to enforce the border, but the team captain could change every four years.<\/p>\n<p>Since the Supreme Court ruling, supporters and opponents have begun their plays. A Texas hospital tried to make money from \u201cbirth tourism.\u201d President Trump demanded the Court rehear the case, declaring \u201cAMERICAN CITIZENSHIP IS NOT FOR SALE!\u201d Strange new rules, like preventing pregnant foreigners from visiting, are now on the table. An ICE shooting in Houston and another in Biddeford, Maine, have only cranked up the heat over how to handle rule breakers.
