America\u2019s political conversation has become a litany of national woes and frustrations: affordability, housing, healthcare, immigration, infrastructure, debt, workforce shortages, energy, national security, childcare, and more.<\/p>

These are not isolated crises. They are symptoms of something much deeper.<\/p>\n

America\u2019s federal government is steadily and visibly losing its ability to govern. Americans have noticed, giving Congress its lowest approval ratings in a generation.<\/p>\n

Affordability is the most visible sign, but by no means the only one. Inflationary pressures were building during the Biden administration long before the conflict in the Middle East drove energy prices higher. Wages have increased, yet many Americans still feel like they are falling behind because structural economic problems remain unresolved, while spending habits established during the pandemic have proven remarkably persistent. Congress continues debating the symptoms while refusing to address the underlying disease.<\/p>\n

That same pattern appears almost everywhere one looks.<\/p>\n

Housing remains scarce and unaffordable because Congress has failed for decades to modernize the federal incentives that shape development and permitting. Healthcare remains dysfunctional because Congress has never produced a coherent long-term framework. Immigration continues to lurch from crisis to crisis because lawmakers have repeatedly postponed meaningful statutory reform. Tuition exploded after Congress expanded financing without adequate safeguards. Regulatory bloat grows because when Congress stops legislating, federal agencies inevitably fill the vacuum. These examples barely scratch the surface. Across virtually every major policy area, Congress has allowed problems to accumulate faster than it resolves them.<\/p>\n

Different problems. One common denominator: Congress has increasingly ceased performing its most fundamental constitutional responsibility: legislating.<\/p>\n

The Founders understood that no single branch of government could govern effectively on its own. They designed three separate branches because they understood both the ambitions and the weaknesses of human nature. Legislative power was intended to produce durable national policy. Executive power was intended to administer those laws. Judicial power was intended to interpret them.<\/p>\n

That balance has steadily eroded.<\/p>\n

As Congress has become less capable of legislating, presidents increasingly govern through executive orders, federal agencies increasingly write rules that resemble legislation, and courts increasingly serve as the final arbiters of public policy. None of those outcomes reflects the constitutional design. They are adaptations to legislative paralysis.<\/p>\n

The evidence is difficult to ignore. Congress has experienced a long-term decline in legislative productivity. This decline did not happen overnight. It is the product of structural incentives that have been developing for decades.<\/p>\n

Party leadership in both parties has centralized authority while suppressing open legislative debate in favor of party discipline. Democrats have generally been more effective at enforcing that discipline than Republicans, but both parties increasingly reward loyalty over independent legislating. Members increasingly function as representatives of party leadership rather than legislators engaged in deliberation, negotiation, and lawmaking.<\/p>\n

Recent presidencies\u2014from Obama through Trump\u2019s two terms\u2014have all collided with the same institutional failings, but Trump\u2019s presidencies reveal the problem most starkly.<\/p>\n

His first administration struggled to advance much of its legislative agenda because Republicans themselves frequently resisted it. His second administration has benefited from greater Republican support, but razor-thin congressional majorities continue to make lasting legislative victories extraordinarily difficult. Every vote becomes decisive. Every compromise becomes magnified. Trump, like others before him, turns to Executive Orders, which last only as long as the executive remains in office.<\/p>\n

Government by executive order cannot produce lasting structural reform because executive orders were never intended to substitute for legislation. They are temporary instruments attempting to compensate for a legislature that no longer legislates. Executive actions can be blocked by courts, delayed through litigation, reversed by subsequent administrations, or quietly resisted by the permanent bureaucracy. Agencies have learned that delay itself is often an effective political strategy. If implementation can simply be postponed long enough, presidential terms expire while legal challenges continue, rendering a president\u2019s legacy muted.<\/p>

The experience of the last decade has repeatedly demonstrated this. Major initiatives involving immigration, regulatory reform, federal workforce restructuring, and administrative spending have become the subject of legal battles almost immediately after their announcement, thrilling opponents and discouraging supporters.<\/p>\n

That reality carries an important lesson for Republicans.<\/p>\n

If Republicans intend to produce lasting change, they cannot rely solely on presidential leadership, regardless of how effective it may be. They must restore Congress to its constitutional role as the nation\u2019s primary lawmaking institution. Legislation must be written with judicial scrutiny in mind. Statutes must contain sufficient clarity that agencies cannot reinterpret them beyond recognition. Oversight and enforcement mechanisms must be built directly into the law rather than assumed after the fact. Threatening this or that legislative maneuver is not governing. It is a form of political desperation that does not substitute for good governance, and our allies and adversaries alike take note.<\/p>\n

Most importantly, Republicans must think institutionally rather than electorally. Durable reform depends upon rebuilding the institutions that outlast any individual president. Presidents come and go. Congress remains. Courts remain. Federal agencies remain.<\/p>\n

None of this requires abandoning Donald Trump, the MAGA movement, or his policy agenda.<\/p>\n

It requires recognizing that no president\u2014not even one willing to challenge Washington\u2019s entrenched interests and to reinvent government\u2014can permanently reform a government whose legislative branch has largely ceased to perform its constitutional function.<\/p>\n

America\u2019s problems are not primarily the result of a shortage of executive action.<\/p>\n

They are the result of a shortage of legislation. Many Americans consider gridlock a virtue because it limits government. But prolonged gridlock is something different. A government that cannot routinely perform its constitutional functions is not exercising restraint; it is failing to govern.<\/p>\n

Until Congress begins governing again, every president will collide with the same institutional paralysis. That paralysis does not merely weaken domestic governance; it signals to adversaries abroad that America\u2019s political system is increasingly incapable of decisive action. History suggests that perceived weakness invites testing, and that is a risk no serious nation should be willing to accept.<\/p>\n

A nation that cannot legislate cannot govern, and a nation that cannot govern cannot endure.<\/p>\n
