{"id":1966,"date":"2026-06-26T11:37:14","date_gmt":"2026-06-26T11:37:14","guid":{"rendered":"https:\/\/interstatelogisticshubs.com\/?p=1966"},"modified":"2026-06-26T11:37:14","modified_gmt":"2026-06-26T11:37:14","slug":"the-perpetual-death-of-the-balanced-budget-amendment","status":"publish","type":"post","link":"https:\/\/interstatelogisticshubs.com\/?p=1966","title":{"rendered":"The Perpetual Death of the Balanced Budget Amendment"},"content":{"rendered":"<div>\n<p>The United States has passed $39 trillion in national debt.\u00a0\u00a0Interest payments will exceed $1 trillion this fiscal year \u2014 the first time debt service has topped ten figures in American history.\u00a0\u00a0That exceeds the entire defense budget.\u00a0\u00a0It exceeds Medicaid.\u00a0\u00a0And the debt accumulates at roughly $8 billion a day.<\/p><p>Read more <a href=\"https:\/\/interstatelogisticshubs.com\/?p=1963\">Back in the Spotlight: Anthony Fauci<\/a><\/p>\n<p>There is a constitutional amendment that would fix this.\u00a0\u00a0It has been introduced in some form in every Congress for four decades.\u00a0\u00a0Virtually every Republican in the House and Senate supports it.\u00a0\u00a0The constitutions of 49 states already require something equivalent.\u00a0\u00a0Polling consistently shows supermajority public support.\u00a0\u00a0It came within a single Senate vote of passing in 1995 and 1997 \u2014 one vote each time, in a body of 100.<\/p>\n<p>It will never pass Congress. That\u2019s a realistic analysis of the structural problem, which is that the institution being asked to constrain itself is the one doing the asking.<\/p>\n<p>A balanced budget amendment follows a straightforward constitutional path.\u00a0\u00a0Article V gives Congress two ways to propose amendments: a two-thirds vote in both chambers or a convention called at the application of two thirds of state legislatures (34 states), with ratification by three quarters of states in either case.\u00a0\u00a0Every balanced budget amendment that has ever reached the floor has used the congressional route.\u00a0\u00a0Every one has failed.<\/p>\n<p>The closest the country ever came was March 1995.\u00a0\u00a0The Republican House, running on the Contract with America, passed the amendment 300-132 \u2014 clearing two thirds with room to spare.\u00a0\u00a0The Senate needed 67 votes.\u00a0\u00a0The recorded tally was 65-35, though Majority Leader Dole voted no for the procedural purpose of preserving reconsideration rights.\u00a0\u00a0True support stood at 66, one vote short.\u00a0\u00a0The single decisive Republican no came from Sen. Mark Hatfield of Oregon.\u00a0\u00a0His vote would not have been needed at all had Sen. Tom Daschle of South Dakota not reversed years of public support under direct pressure from the Clinton White House.\u00a0\u00a0Daschle\u2019s reversal made Hatfield the story.\u00a0\u00a0The arithmetic was simple: Two senators killed what 49 state constitutions had already imposed on their own governments.<\/p>\n<p>In 1997, the Senate voted again.\u00a0\u00a0The tally was 66-34 \u2014 one short of the 67 required.\u00a0\u00a0The decisive defection belonged to Sen. Robert Torricelli of New Jersey, who had voted for the amendment as a House member, campaigned for the Senate in 1996 as a declared supporter, and then voted no when it counted.\u00a0\u00a0He never offered a satisfactory public explanation.<\/p>\n<p>No Senate vote on a balanced budget amendment has been held in the 29 years since.<\/p>\n<p>The most recent House attempt was H.J.Res. 139, introduced by Rep. Andy Biggs of Arizona and championed on the floor by House Budget Committee chairman Jodey Arrington of Texas, who called the vote a moment for \u201cintellectual honesty\u201d: \u201cBoth parties have failed.\u00a0\u00a0This institution has failed.\u201d\u00a0\u00a0The House voted 211-207 on March 18, 2026 \u2014 every Republican yes, every Democrat no except Rep. Henry Cuellar of Texas.\u00a0\u00a0It wasn\u2019t even close to two thirds.\u00a0\u00a0It didn\u2019t need to be a dramatic failure to confirm the pattern.\u00a0\u00a0It was an ordinary one.<\/p>\n<p>Congress will not pass a balanced budget amendment for the same reason no legislature in history has voluntarily surrendered its spending authority without external compulsion.\u00a0\u00a0Deficit spending isn\u2019t a bug in congressional behavior \u2014 it\u2019s the feature that makes congressional careers possible.\u00a0\u00a0Benefits win elections.\u00a0\u00a0Benefits cost money.\u00a0\u00a0Borrowing is how you deliver benefits without presenting the bill in the same term.\u00a0\u00a0A balanced budget amendment ends that arrangement.\u00a0\u00a0Every member who votes for it is voting to strip future congresses \u2014 including their next term \u2014 of the tool that sustains incumbency.<\/p>\n<p>I\u2019ve spent thirty years advising institutions whose investment committees operate under legally enforceable fiduciary duties.\u00a0\u00a0Borrow recklessly \u2014 trustees, regulators, and courts step in.\u00a0\u00a0Congress faces none of those constraints.\u00a0\u00a0That gap between institutional accountability and congressional self-dealing is structural, and it explains why the only governments in this country that reliably balance their budgets are the ones constitutionally required to do so.<\/p><p>Read more <a href=\"https:\/\/interstatelogisticshubs.com\/?p=1960\">U.S. media aggressively ignore the UK\u2019s Rape Report and Henry Nowak\u2019s death<\/a><\/p>\n<p>That\u2019s why 49 states have accomplished what Congress has not.\u00a0\u00a0State legislators face the same political incentives.\u00a0\u00a0The difference is that most state constitutions imposed balanced budget requirements before the modern political class organized around deficit spending as a career strategy.\u00a0\u00a0The structural constraint came first; the political adaptation followed.\u00a0\u00a0Congress has never been subject to that constraint and shows no intention of choosing it voluntarily.<\/p>\n<p>This is why the Article V convention route matters.\u00a0\u00a0The Founders included it because a Congress with interests adverse to constitutional reform won\u2019t propose amendments that constrain it.\u00a0\u00a0In Federalist 85, Alexander Hamilton was explicit: The words of Article V are \u201cperemptory.\u201d\u00a0\u00a0Congress \u201cshall call a convention,\u201d and \u201cnothing in this particular is left to the discretion of that body.\u201d\u00a0\u00a0He added that \u201cwe may safely rely on the disposition of the State legislatures to erect barriers against the encroachments of the national authority.\u201d<\/p>\n<p>Twenty-seven states have submitted active applications for a balanced budget convention.\u00a0\u00a0The Convention of States movement \u2014 focused on fiscal restraints, limiting federal power, and term limits \u2014 has separately passed its resolution in 20 states.\u00a0\u00a0House Budget chairman Arrington introduced H.Con.Res. 15 in 2025 arguing that the balanced budget application count may already have reached 34 states historically, creating a constitutional obligation Congress has ignored.\u00a0\u00a0That argument remains contested.\u00a0\u00a0What\u2019s not contested is that 34 states acting consistently would create an obligation Congress couldn\u2019t simply ignore.<\/p>\n<p>Critics raise two objections.\u00a0\u00a0The runaway convention argument \u2014 that a convention called for one purpose could propose amendments on any subject \u2014 is disputed by constitutional scholars and unsupported by the historical record;
